Welcome to Prep For Certs. These Terms of Service ("Terms") govern your use of our website at prepforcerts.org and our certification exam preparation services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use after changes constitutes acceptance.

2. Description of Service

Prep For Certs provides an online platform for IT certification exam preparation, including:

• adaptive practice questions based on certification exam outlines
• Progress tracking and readiness scoring
• Study streak monitoring and milestone achievements
• Custom certification creation
• AI study assistant (for premium subscribers)

Our Service is intended as a supplementary study tool and should be used alongside official certification materials.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 18 years old to create an account or use this Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years of age. If you are under 18 years old, you may not use the Service under any circumstances.

Free users have access to limited daily questions and basic features. Free tier limitations are subject to change.

4.2 Paid Subscriptions

We offer Plus (monthly/annual) and Lifetime subscription plans with enhanced features including unlimited questions, AI study assistant, and priority support.

4.3 Payment Processing

Payments are processed securely through Stripe. By subscribing, you agree to Stripe's terms of service. All prices are in USD unless otherwise stated.

4.4 Billing and Renewal

Subscriptions automatically renew unless canceled before the renewal date. You may cancel your subscription at any time through your account settings or the Stripe customer portal.

4.5 Refund Policy

All sales are final. No refunds will be issued for any subscription plan, including Plus (monthly/annual) and Lifetime subscriptions. By subscribing, you acknowledge that you have access to our free tier to evaluate the Service before purchasing. Due to the digital nature of our adaptive content, which can be accessed and used immediately upon purchase, we cannot offer refunds. We encourage you to thoroughly explore the free tier before committing to a paid subscription.

5. Adaptive Content

Our practice questions are generated using artificial intelligence. You acknowledge and agree that:

• adaptive content may contain errors, inaccuracies, or outdated information
• Questions may not reflect the exact format or difficulty of actual certification exams
• We do not guarantee that studying with our Service will result in passing any certification exam
• You should verify critical information with official certification documentation

6. Acceptable Use

You agree NOT to:

• Share, sell, or distribute practice questions outside the platform
• Use automated tools to scrape or collect content from the Service
• Attempt to reverse engineer or extract our AI models or algorithms
• Create multiple accounts to circumvent usage limits
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Upload malicious content or code
• Violate any applicable laws or regulations

7. Intellectual Property

7.1 Our Content

The Service, including its design, features, and adaptive content, is owned by Prep For Certs and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7.2 Your Content

You retain ownership of any content you submit (e.g., custom certification outlines, suggestions). By submitting content, you grant us a non-exclusive license to use it for providing and improving the Service.

7.3 Trademarks

Certification names (e.g., CompTIA, Cisco, AWS, CISSP) are trademarks of their respective owners. Prep For Certs is not affiliated with or endorsed by any certification body.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• RESULTS FROM USING THE SERVICE

We do not warrant that the Service will meet your specific requirements or that using our Service will guarantee success on any certification exam.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREP FOR CERTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Costs of substitute services
• Any damages arising from your use or inability to use the Service
• Failure to pass any certification exam

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Prep For Certs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

11. Third-Party Services

The Service integrates with third-party services including Supabase, Stripe, and OpenAI. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their availability.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
